License Agreement for
Perfect Sync's DOSBox Tools Versions 1.00-1.99PLEASE READ THIS ENTIRE DOCUMENT.
It describes your legal rights and obligations.IMPORTANT NOTE: This product was previously known as DOSBox. To avoid confusion with another popular software package with that name, it is now called DOSBox Tools. The two products are not related, and they provide completely different functionality.
IMPORTANT NOTE: In this document, "DOSBox Tools" refers to Perfect Sync's DOSBox Tools Version 1, i.e. DOSBox Tools packages with version numbers 1.00 through 1.99. This License Agreement is separate and distinct from the License Agreements for versions of DOSBox Tools greater than 1.99.
Your use of DOSBox Tools is legally restricted by the terms of the Software License that accompanies the DOSBox Tools package. You are legally responsible for making sure that the terms of the License Agreement are followed. Please read the entire Software License Agreement for complete information about your legal rights and responsibilities.
DOSBox Tools is available in two different forms:
1) The Registered Version, which is fully functional and provides all of the features described in the DOSBox Tools documentation, and...
2) The Shareware Version, which is almost fully functional and contains additional copyright notices and brief delays. For more details, see "The Shareware Version of DOSBox Tools" in the DOSBox Tools documentation.
The Shareware Version is available for download from a variety of sources on the internet, at no charge. Shareware is provided on the Honor System. If you find DOSBox Tools to be useful, we encourage you to purchase the Registered Version of the package from Perfect Sync Software. You will receive a version of DOSBox Tools that does not have any extra delays and does not display any copyright messages.
Users of the Registered Version of DOSBox Tools receive the additional benefit of no-charge DOSBox Tools updates (bug fixes, etc.) by electronic mail for a period of at least one full year from the date of registration. You will also receive a printable PDF (Adobe Acrobat) version of the DOSBox Tools documentation, among other benefits.
We recommend that users of the Shareware version periodically check the Perfect Sync web site (perfectsync.com) to find out whether or not a new Shareware version of DOSBox Tools is available for download. (Sorry, but Perfect Sync is unable to honor requests for email notification about new Shareware versions of DOSBox Tools, except by major web sites that make the DB_Share.EXE file available for downloading.)
By using DOSBox Tools you agree to the following terms:
GENERAL
Except where explicitly specified, all terms apply to both the Shareware and Registered versions of the DOSBox Tools executable program, sample source code, documentation, data, and incidental files, collectively referred to hereafter as "DOSBox Tools", the "software" or the "package".
This license and your right to use the software shall terminate automatically if you violate any part of this agreement. In the event of termination, you shall immediately destroy all copies of the software or return them at your sole expense to Perfect Sync, Inc.
All DOSBox Tools components are protected by United States copyright law and international treaties. The software remains the property of Perfect Sync, Inc..
DOSBox Tools is Copyright © 2000 Perfect Sync, Inc. All Rights Reserved.
Perfect Sync, Inc. grants you (hereafter referred to as the "user") a nonexclusive, nontransferable license to copy and use the software only in accordance with the terms and conditions of this Agreement. The user may not sublicense, rent, lease, or assign any portion of the software.
DOSBox Tools Shareware License
The DOSBox Tools Shareware License allows you to install the contents of the DOSBox Tools Shareware Package (the contents of the DB_Share.EXE installation file) on an unlimited number of computers, and to distribute the DB_Share.EXE file, under the conditions that: 1) The user shall always copy the software in its entirety without any additions, deletions or modifications whatsoever. 2) The user shall keep intact all notices that refer to this License and to the absence of a warranty, 3) The user shall not distribute or use the software (or any part thereof) for any commercial purpose whatsoever, nor charge any fee for the medium on which the user stores or transfers the software, without the prior written permission of Perfect Sync, Inc., 4) Before distributing a copy of the DB_Share.EXE file the user shall compare the contents of the file to the file list in the FILELIST.TXT file to insure that all of the necessary files are present and that they have not been removed or altered by another party.
DOSBox Tools Registered License
The DOSBox Tools Registered License is available only from Perfect Sync, Inc.and from our Authorized Resellers.
The DOSBox Tools Registered License allows Registered users to install the DOSBox Tools Registered Package (the contents of the DB_Reg.EXE installation file as originally received from Perfect Sync or an Authorized Reseller) on a single development computer. If the Registered Version of the package is installed on a computer network, you must obtain a separate license for each network workstation where the package can be used for software development.
Registered users of DOSBox Tools may also distribute the Registered Version of the DOSBox Tools.EXE executable file with for-profit and/or corporate applications that the Registered user develops and that require the DOSBox Tools.EXE file to operate properly. Other DOSBox Tools components, such as the documentation and sample source code, may not be distributed. The Registered Version of DOSBox Tools.EXE may not be included as a generic component of a "toolbox" or "utility" package, or used in Shareware, Freeware, Public Domain, or Demo software without the prior written permission of Perfect Sync, Inc. (Contact support at perfectsync.com to apply for permission.) Users of the Registered Version may, however, distribute the Shareware Version of DOSBox Tools with those types of programs.
LIMITED WARRANTY
Perfect Sync, Inc. warrants that the physical disks (if any) and physical documentation (if any) are free of defects in workmanship and materials for a period of thirty (30) days from the date of purchase. If the disks or documentation are found to be defective within the warranty period, Perfect Sync, Inc. will replace the defective items at no cost to you. The entire liability of this warranty is limited to replacement and shall not, under any circumstances, encompass any other damages.
PERFECT SYNC, INC. SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
MISCELLANEOUS
The user shall not reverse-engineer, disassemble, or decompile any portion of the software.
The user shall not transfer Registration information (serial numbers, security keys, etc.) to any other party without the prior, written permission of Perfect Sync, Inc.
GOVERNING LAW
This license and limited warranty shall be construed, interpreted, and governed by the laws of the State of Michigan of the United States of America, and any action hereunder shall be brought only in Michigan. If any provision is found to be or becomes invalid or unenforceable, the balance of this license and limited warranty shall remain valid and enforceable. Use, duplication, or disclosure by the U.S. Government of the computer software and documentation in this product shall be subject to the restricted rights under DFARS 52.227-7013 applicable to commercial computer software. All rights not specifically granted herein are reserved by Perfect Sync, Inc.
